    Bigpoint S.à.r.l. and Co, SCS and Bigpoint Inc. run prize games/contests on their websites at [http://www.farmerama.com and https://www.facebook.com/farmerama]. Participation in prize games/contests and the execution of such prize games/contests are subject to the following provisions. Changes made in respect to the provisions of this prize game/contest can be found in the respective prize game/contest announcement.

    § 1 Prize game/contest

    (1) The prize game/contest is run in cooperation with different partners.
    (2) Participants take part in the prize game/contest by completely registering for the prize game/contest within the specified time and by respecting all prize game/contest rules. Specific rules regarding the registration process and the prize game/contest procedure are published in the respective prize game/contest announcement.

    § 2 Participants

    (1) All personal information provided by participants must reflect the truth in order to participate in the game prize.

    (2) Residents living in the following states of the United States of America are not entitled to prizes and therefore cannot participate in the prize game/contest: Arkansas, Arizona, Connecticut, Florida, Delaware, Indiana, Iowa, Illinois, Louisiana, Maryland, Montana, Nebraska, South Dakota, South Carolina, Tennessee or Vermont. Residents of Italy or Brazil are only entitled to a prizes limited to a real value of €150.

    § 3 Exclusion from Participation

    (1) Employees of Bigpoint and any other associated companies in the Bigpoint Group as well as as any concerned business partners and their relatives are not allowed to participate in the prize game/contest.

    (2) Bigpoint is entitled to immediately and retroactively exclude any and all persons who infringe these Terms and Conditions of Participation. In this case, Bigpoint can subsequently deny and reclaim cash prizes, if necessary.

    (3) Persons who avail themselves of any unauthorized help or who arrange to benefit from any kind of advantage through manipulation of the game/contest shall also be excluded. In this case, Bigpoint can subsequently deny and reclaim cash prizes, if necessary.

    § 4 Implementation and Execution

    (1) The implementation and execution of the prize game/contest and the choice of prize is incumbent upon Bigpoint and/or the relevant partner(s), where applicable.
    (2) Terms prescribing the transfer of prizes are defined by Bigpoint and its partners. If it is not possible for the agreed-upon prize to be transferred/delivered or if transfer/delivery of the prize is only possible under unreasonable circumstances, the prize winner shall receive a substitute prize of equal value.

    (3) Bigpoint will inform winner(s) in writing and publish their name(s) on the pages and/or partner site(s) named in the prize game/contest announcement. The winner of the prize game/contest hereby declares their agreement with this form of publication. Bigpoint reserves the right to transfer information about the winner to partners for the purpose of transferring/delivering prizes.

    In the case that Bigpoint only has the winner's e-mail address, the winner will be notified by e-mail. Should the winner not answer within a period of four weeks after the initial e-mail was officially sent, the right to the prize will expire and a new winner will be chosen via a drawing.
    The right to the prize will also expire if the prize cannot be transferred to the winner within six months after being informed about the winnings the first time, due to reasons leading back to the winner.

    (4) Each participant is only entitled to one prize per prize game/contest. If multiple participants find the right solution, the winner will be decided by a drawing.

    (5) Cash payment of prizes is not possible. Prizes are non-transferable.

    (6) Complaints regarding the prize game/contest must be made to Bigpoint in writing within 14 days from the date the reason for the complaint arose. Complaints made by telephone or complaints made too late cannot be addressed.

    (7) The prize presented within the context of the prize game/contest may not necessarily be identical to the prize actually presented to the winner; differences in regards to the model, color, etc. may occur. The prize sponsor can select a similar prize which is of average kind and quality to the original prize presented.

    (8 ) Should a minor win, their legal representatives are the only persons who can accept the prize on their behalf.

    § 5 Premature termination of the prize game/contest

    Bigpoint reserves the right to interrupt or prematurely terminate the prize game/contest at any time and without notification. Bigpoint may avail itself of this right when a prize game/contest cannot run its full course due to technical reasons (e.g. a virus in the computer system, manipulation of the prize game/contest or errors in hardware and/or software). Bigpoint may also do so if the prize game/contest cannot properly be carried out due to legal reasons. If an interruption or termination occurs as a direct result of participant actions, Bigpoint has the right to claim any damages resulting from this person's actions.

    § 6 Data Privacy

    (1) Registration is absolutely necessary in order to participate in a prize game/contest. An entitlement to registration is not guaranteed. Upon registration, the participant expressly allows Bigpoint to save necessary data for the duration of the prize game/contest. The participant has the right to revoke this agreement and thereby cancel their participation at any time.

    (2) With respect to the registered data of participants, Bigpoint undertakes to respect the provisions of the Data Privacy and Media Law. All data will be treated with the utmost confidentiality. Collected data will be used by the Group itself and its cooperation partners for the purpose of research, marketing and advertising.

    § 7 Liability

    (1) All of Bigpoint's obligations end with the delivery of the prize. Bigpoint is not liable for any legal and/or material defects.

    (2) Any claims relating to received prizes are to be made directly to the partner who awarded the prizes.

    (3) The disclosure of the winners is made without guarantee.

    (4) Bigpoint does not assume liability for damages which occur as a result of defective, delayed or interrupted transmission, failures/trouble of technical equipment and services, incorrect content, loss or deletion of data, viruses or in some other way through participating in prize games, unless these damages occur as a result of willful intent or gross negligence of Bigpoint (its governing bodies, employees or vicarious agents).

    (5) No liability exists for persons excluded through § 3 of these Terms and Conditions of Participation.

    § 8 Miscellaneous

    (1) No legal recourse is allowed.

    (2) These Terms and Conditions of Participation, as well as the entire legal relationship between Bigpoint and participants, are subject to the Law of the Federal Republic of Germany.

    (3) In the event that one or more provisions of these Terms and Conditions of Participation should be or become invalid, the other provisions of these Terms and Conditions shall remain unaffected.

    (4) Bigpoint reserves the right to modify these Terms and Conditions of Participation at any time and without notice.
